DUI Charges and the ARD Program

If you are convicted of first-offense intoxicated driving with a BAC of 0.08% or greater (but less than 0.10%), you could receive up to six months of probation and hundreds of dollars in fines.  If you have a high BAC, prior offenses, or if there are other aggravating factors, those penalties could increase to years of jail time, thousands of dollars in fines, and a yearlong license suspension.  If your DUI involves serious injury or death, you may be facing felony charges.

However, our Berks County DUI attorneys have an excellent track record in court.  We have worked on thousands of these cases, and over 98% of our first-time DUI clients receive no jail time, and no criminal record.

Furthermore, first-time offenders with clean criminal records may be eligible for enrollment in Pennsylvania’s ARD (Accelerated Rehabilitative Disposition) Program.  If you are accepted to participate in ARD, you will not have to plead guilty or be convicted, and your charges will be dismissed.

Like DUI, assault is a common charge in Berks County and across Pennsylvania. Depending on the extent of injury to the victim, and factors such as the use or threatened use of a weapon, assault charges can be treated as misdemeanor or felony grade.  A misdemeanor assault conviction could result in two years of imprisonment and $5,000 in fines, while a felony such as aggravated assault could trigger several decades of incarceration and $25,000 in restitution.  On either end of the legal spectrum, these are very serious allegations.

  • Aggravated Assault
